Consumers still have a few weeks left to file a claim to obtain restitution from a consumer fraud settlement with Sun City pest control companies Atomic Pest Control and Amera Pest Control. Consumers who believe they may be eligible for restitution must submit a claim with supporting documents to the Arizona Attorney General’s Office by July 12, 2021.
According to the Arizona Attorney General’s Office (AGO), in April 2021, the court approved a consent decree to resolve the AGO’s lawsuit against Atomic Pest Control and its manager, John Nelson Beebe. The Attorney General’s Office (AGO) alleged that Atomic Pest Control violated its contract with consumers by purchasing Amera Pest Control in 2017 but failing to honor Amera’s existing termite warranties, and then charging some consumers a $125 “activation fee” to use their existing warranties.
The settlement requires the defendants to pay $100,000 in restitution to Arizona consumers who did not get the full value of their termite warranties or who paid the activation fee. It further requires Atomic Pest Control to honor termite warranties of eligible consumers. Atomic will honor these termite warranties through the originally agreed-upon date or December 31, 2024, whichever is earlier, at no further cost to the customer. Atomic will also continue to honor the warranties of those customers that have paid Atomic’s $125 activation fee.
